Welcome to MCPBodega. By using our service, you agree to these Terms of Service. Please read them carefully.

1. Service Description

MCPBodega ("we", "our", "us") provides a platform for hosting, managing, and monitoring Model Context Protocol (MCP) servers. Our service includes infrastructure provisioning, container orchestration, monitoring, and management tools.

Important: MCPBodega is an independent platform operated by CycleCore Technologies LLC. We are not affiliated with, endorsed by, or officially connected to GitHub, Slack, Google, or any other third-party services that may be integrated through our OAuth connections or MCP catalog. When you connect third-party accounts (GitHub, Slack, Google Drive, etc.), you are authorizing MCPBodega to access those services on your behalf according to the permissions you grant. Those third-party services have their own terms of service and privacy policies which govern your use of their platforms.

2. Account Terms

  • You must provide a valid email address to create an account.
  • You are responsible for maintaining the security of your account and password.
  • You are responsible for all activity that occurs under your account.
  • You must be at least 18 years old to use this service.
  • You may not use the service for any illegal or unauthorized purpose.

3. Acceptable Use Policy

You agree not to:

  • Use the service to store, host, or transmit illegal content or content that violates third-party rights.
  • Use the service to distribute malware, viruses, or other malicious code.
  • Attempt to gain unauthorized access to our systems or other users' accounts.
  • Use the service for cryptocurrency mining without explicit written permission.
  • Abuse, harass, threaten, or intimidate other users or our staff.
  • Use the service in a way that could damage, disable, or impair our infrastructure.
  • Resell or redistribute the service without our written permission.

4. Third-Party Service Compliance

4.1 Your Responsibility

When you connect third-party accounts (GitHub, Slack, Google Drive, etc.) to MCPBodega:

  • You are responsible for complying with those services' Terms of Service
  • You must have proper authorization to access the accounts you connect
  • You agree not to use MCPBodega to violate any third-party service policies
  • You are solely responsible for your use of third-party APIs and data
  • You are responsible for complying with all applicable laws, regulations, and legal requirements in your jurisdiction, including but not limited to data protection laws (GDPR, CCPA, etc.), export control laws, and industry-specific regulations

4.2 Prohibited Uses with Third-Party Services

You may not use MCPBodega to:

  • Scrape or collect data from third-party services without authorization
  • Exceed rate limits or abuse API quotas of connected services
  • Access accounts you don't have permission to use
  • Violate any third-party service's acceptable use policies
  • Circumvent security measures or authentication requirements

4.3 Third-Party Enforcement

If a third-party service (GitHub, Slack, Google, etc.) notifies us that your use of MCPBodega violates their Terms of Service:

  • We may suspend or terminate your account
  • We may disable specific integrations
  • You remain solely responsible for any violations
  • We will cooperate with third-party service providers to investigate abuse

4.4 No Liability for Third-Party Actions

MCPBodega is not responsible if:

  • A third-party service revokes your access
  • Your account is suspended by a third-party service
  • You violate a third-party service's Terms of Service
  • Third-party APIs change, break, or become unavailable

4.5 Indemnification

You agree to indemnify and hold harmless MCPBodega, CycleCore Technologies LLC, and our affiliates against any claims, damages, or expenses arising from: (a) your violation of third-party service Terms of Service, (b) your violation of applicable laws or regulations in your jurisdiction, or (c) your use of MCPBodega in a manner that infringes upon the rights of any third party.

5. Service Levels and Availability

Note: MCPBodega is currently in beta. While we strive for reliability, we recommend testing thoroughly before deploying mission-critical workloads.

Free Tier:

  • Provided "as-is" with no uptime guarantees.
  • We may suspend or terminate free accounts at any time for any reason.
  • No SLA (Service Level Agreement) applies.
  • Not recommended for production use.

Paid Tiers (Pro, Team, Business):

  • We target 99% uptime but do not guarantee it during the beta period.
  • Planned maintenance will be announced at least 24 hours in advance when possible.
  • We are not liable for downtime caused by third-party services (DigitalOcean, internet providers, etc.).
  • Not recommended for mission-critical production workloads during beta.

6. Payment Terms

  • Paid plans are billed monthly in advance via Stripe.
  • All fees are in USD and non-refundable except as required by law or stated in our Refund Policy.
  • We reserve the right to change pricing with 30 days' notice.
  • Plan Changes: We reserve the right to modify, discontinue, or change subscription plans, features, or resource limits at any time without prior notice. If such changes materially affect your current paid subscription tier, you will be notified via email at least 30 days before your next billing cycle. Continued use of the service after notification constitutes acceptance of the changes. You may cancel your subscription if you do not agree to the changes.
  • Failure to pay will result in service suspension or termination.
  • You are responsible for all taxes associated with your use of the service.

7. Refund Policy

  • You may request a refund within 30 days of your initial subscription.
  • Refunds are pro-rated based on unused service time.
  • To request a refund, email hi@cyclecore.ai.
  • Refunds are processed within 5-10 business days.

8. Data and Privacy

  • We collect and use your data as described in our Privacy Policy.
  • You retain all rights to your content and data.
  • We may access your data to provide support, prevent abuse, or comply with legal obligations.
  • You are responsible for backing up your data. We are not liable for data loss.

9. Intellectual Property

  • The MCPBodega platform, including all software, designs, and trademarks, is owned by CycleCore Technologies LLC.
  • You may not copy, modify, distribute, or reverse-engineer our service.
  • You grant us a license to host and process your content solely to provide the service.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • MCPBodega is provided "AS-IS" without warranties of any kind, express or implied.
  • We do not warrant that the service will be uninterrupted, secure, or error-free.
  • We are not liable for any indirect, incidental, special, or consequential damages.
  • Our total liability to you is limited to the amount you paid us in the 12 months prior to the claim, or $100, whichever is less.
  • We are not liable for damages caused by third-party services, user error, or force majeure events.

11. Termination

  • You may cancel your account at any time from the dashboard or by emailing us.
  • We may suspend or terminate your account for violating these Terms, non-payment, or abusive behavior.
  • Upon termination, your data will be deleted within 30 days unless legally required to retain it.
  • You are responsible for exporting your data before termination.

12. Dispute Resolution

  • These Terms are governed by the laws of the State of Wyoming, USA.
  • Any disputes will be resolved through binding arbitration in Wyoming, except where prohibited by law.
  • You waive the right to participate in class-action lawsuits against us.

13. Changes to Terms

These Terms may be updated from time to time to reflect changes in our service, legal requirements, or business practices.

  • Current Version: The most up-to-date version of these Terms will always be available at mcpbodega.com/terms.
  • Updates: We may modify these Terms at any time by posting the revised version on this page with an updated "Last Updated" date.
  • Notification: For material changes that affect your rights or obligations, we will notify you via email or a prominent notice in the dashboard.
  • Acceptance: Continued use of the service after changes are posted constitutes your acceptance of the revised Terms.
  • Your Responsibility: We encourage you to review this page periodically to stay informed of any updates.
  • Disagreement: If you do not agree with the modified Terms, you must stop using the service and may close your account.
